บริษัท เรเดียม จำกัด ให้คุณค่ากับความเป็นส่วนตัวของท่าน นโยบายในความเป็นส่วนตัวฉบับนี้จะบอกทางเลือกของท่านและการดำเนินการของเราเกี่ยวกับข้อมูลที่ท่านให้กับเรา

การเปลี่ยนแปลงนโยบายความเป็นส่วนตัวฉบับนี้

นโยบายความเป็นส่วนตัวนี้อาจถูกเปลี่ยนแปลงแก้ไขได้เป็นครั้งคราว หากมีการเปลี่ยนแปลงหรือเพิ่มเติมวิธีการใช้ ประมวลผลข้อมูลส่วนบุคคลของท่านตามที่ระบุไว้นี้ส่งผลกระทบต่อท่าน ท่านจะได้รับการติดต่อผ่านช่องทางที่เหมาะสม ยกตัวอย่างเช่น เราอาจจะแจ้งเตือนให้ท่านทราบอย่างชัดเจนบนหน้าบริการหรือส่งอีเมล์ให้ท่านทราบถึงการเปลี่ยนแปลงดังกล่าว

1. ข้อมูลที่เราเก็บรวบรวมและเราเก็บรวบรวมข้อมูลอย่างไร

ในการให้บริการของเรา เราได้เก็บรวบรวม เก็บรักษาและใช้ข้อมูลของท่านดังต่อไปนี้

“ข้อมูล” ได้แก่ ข้อมูลส่วนบุคคล และข้อมูลที่มิใช่ข้อมูลส่วนบุคคล

"ข้อมูลส่วนบุคคล" ได้แก่ ข้อมูล หรือการรวมกันของข้อมูลซึ่งเกี่ยวกับท่านและสามารถใช้ระบุตัวตนของท่านได้ โดยที่ข้อมูลส่วนบุคคล อาจรวมถึงข้อมูลดังต่อไปนี้

· ข้อมูลที่ท่านให้แก่เราเมื่อมีการเปิดบัญชีหรือใช้บริการของเรา เช่น ชื่อ หมายเลขโทรศัพท์ อีเมล์แอดเดรส และข้อมูลบัตรเครดิต

· ข้อมูลที่ท่านใช้กับบริการของเรา รวมถึง ข้อมูลที่แบ่งปันร่วมกันที่ท่านจัดส่งให้แก่บุคคลอื่นๆ ผ่านทางบริการของเราและข้อมูลที่ท่านเก็บรักษาโดยใช้บริการของเรา

· ข้อมูลที่แบ่งปันร่วมกันกับผู้อื่นที่ใช้บริการของเราที่ได้จัดส่งให้แก่เรา เช่น ข้อมูลที่ระบุในกระทู้ที่มีการตั้ง และการติดต่อสื่อสารกับท่านและผู้อื่นที่ใช้บริการของเรา และ

· ข้อมูลที่เราเก็บรวบรวมจากการที่ท่านใช้บริการของเรา เช่นข้อมูลเกี่ยวกับตำแหน่งพื้นที่บางแห่ง ข้อมูลเกี่ยวกับการใช้บริการ และข้อมูลสาธารณะ

“ข้อมูลเกี่ยวกับตำแหน่งพื้นที่” ได้แก่ ข้อมูลที่เราเก็บรวบรวมเกี่ยวกับตำแหน่งพื้นที่ของท่าน (เมื่อท่านมีการเปิดใช้บริการเกี่ยวกับตำแหน่งพื้นที่) ซึ่งรวมถึง:

· ตำแหน่งพื้นที่ของอุปกรณ์ของท่านเมื่อท่านใช้บริการของเรา เช่น ข้อมูลจาก GPS WiFi เข็มทิศ เครื่องวัดความเร่ง หรือการตรวจจับการเคลื่อนไหวอื่นในอุปกรณ์ของท่าน

· ไอพีแอดเดรสของอุปกรณ์หรือบริการทางอินเตอร์เน็ตที่ท่านใช้ในการเข้าถือบริการของเรา

· ข้อมูลอื่นๆ ที่ท่านจัดส่งให้กับเราหรือบุคคลอื่นซึ่งทำให้สามารถระบุตำแหน่งของท่าน หรือสถานที่ที่ท่านอยู่ได้ และข้อมูลที่แบ่งปันร่วมกันที่ท่านหรือบุคคลอื่นระบุซึ่งสามารถบ่งชี้ตำแหน่งพื้นที่ของท่านได้ เช่น ข้อมูลพิกัดตำแหน่งที่ได้ติดตั้งอยู่ในรูปภาพที่ท่านส่งมายังเรา และ

· ในกรณีที่ท่านได้ส่งข้อมูลเกี่ยวกับตำแหน่งพื้นที่ของท่านให้กับเราไว้ก่อนหน้านี้ และประสงค์จะให้เราลบข้อมูลดังกล่าวออก ท่านสามารถดำเนินการได้ผ่านทางบริการของเรา

"ข้อมูลเกี่ยวกับการเข้าใช้บริการ" ได้แก่ ข้อมูลทางเทคนิคที่เรามีการเก็บรวบรวมโดยอัตโนมัติเมื่อท่านใช้บริการของเรา ไม่ว่าจะผ่านทางการใช้งานหรือทางคุกกี้ (ตามที่จะมีการอธิบายในรายละเอียดใน นโยบายเกี่ยวกับคุกกี้) หรือข้อมูลอื่นๆ ซึ่งรวมถึง:

· ข้อมูลทางเทคนิค เช่น ผู้ให้บริการโทรศัพท์เคลื่อนที่ของท่าน ข้อมูลการตั้งค่าที่ส่งให้แก่เราโดยเว็บเบราเซอร์หรือโปรแกรมอื่นๆ ซึ่งท่านใช้ในการเข้าถึงบริการของเรา ไอพีแอดเดรสของท่าน เวอร์ชั่นและเลขทะเบียนของอุปกรณ์ของท่าน

· ข้อมูลเกี่ยวกับการสืบค้นและการรับชมในขณะที่ท่านใช้บริการของเรา เช่น คำสืบค้นที่ได้ใช้ บัญชีโซเชียลมีเดียที่ท่านเข้าชม ข้อมูลและเนื้อหาอื่นๆ ที่เกี่ยวข้อง ซึ่งเข้าถึงหรือมีการส่งคำร้องขอจากท่านในการใช้บริการของเรา

· ข้อมูลเกี่ยวกับ whatapps และซอฟต์แวร์อื่นๆ ซึ่งท่านใช้และวิธีการที่ท่านใช้ซอฟต์แวร์เหล่านั้น

· ข้อมูลเกี่ยวกับการติดต่อสื่อสารซึ่งท่านใช้ในบริการของเรา เช่น บุคคลซึ่งท่านได้มีการติดต่อสื่อสารด้วย และเวลา รวมถึง ระยะเวลาที่ท่านติดต่อสื่อสารด้วย และข้อมูลกำกับ (metadata) ซึ่งหมายถึงข้อมูลที่เกี่ยวข้องกับรายการที่ท่านได้ใช้ผ่านบริการของเราเช่น วันที่ เวลาหรือตำแหน่งพื้นที่ซึ่งรูปภาพหรือวีดีโอที่ได้ทำการแบ่งปันข้อมูลมานั้นได้ถูกทำขึ้นหรือโพสต์ไว้

“ข้อมูลที่ไม่ใช่ข้อมูลส่วนบุคคล” ได้แก่ ข้อมูลใดๆ ที่เกี่ยวข้องกับท่านแต่ไม่สามารถใช้ในการระบุตัวตนของท่านไม่ว่าโดยตรงหรือโดยอ้อม รวมถึงข้อมูลส่วนบุคคลในรูปแบบของข้อมูลสรุปหรือไม่มีการเปิดเผยขื่อ หรือเป็นนามปากกา

“ข้อมูลที่แบ่งปันร่วมกัน” ได้แก่ข้อมูลเกี่ยวกับท่านหรือเกี่ยวข้องกับท่านซึ่งได้มีการแบ่งปันในบริการของเราอย่างสมัครใจ รวมถึงการโพสต์ข้อมูลซึ่งท่านใช้ในบริการของเรา (รวมถึงโปรไฟล์สาธารณะของท่านและรายการที่ท่านสร้างขึ้น) ข้อมูลการโพสต์ของบุคคลอื่น ซึ่งท่านได้นำไปโพสต์ซ้ำรวมไปถึงข้อมูลเกี่ยวกับตำแหน่งพื้นที่และข้อมูลเกี่ยวกับการเข้าใช้บริการที่เกี่ยวข้องกับการโพสต์ดังกล่าว ทั้งนี้ ข้อมูลที่แบ่งปันร่วมกันยังรวมไปถึงข้อมูลเกี่ยวกับท่าน (ยังรวมไปถึงข้อมูลเกี่ยวกับตำแหน่งพื้นที่และข้อมูลเกี่ยวกับการเข้าใช้บริการ)ซึ่งผู้อื่นที่ได้ใช้บริการของเราได้แบ่งปันข้อมูลดังกล่าว เกี่ยวกับท่าน

2. เราใช้ข้อมูลของท่านอย่างไร

เราอาจใช้ข้อมูลของท่านเพื่อวัตถุประสงค์ดังต่อไปนี้:

· เพื่อให้บริการของเราแก่ท่าน

· เพื่อวัตถุประสงค์ในการให้บริการแก่ลูกค้า ความปลอดภัย การตรวจสอบการทุจริต คลังข้อมูลและการสำรองข้อมูลที่เกี่ยวข้องกับการให้บริการของเรา

· เพื่อการโฆษณาแก่ท่าน (ตามที่ปรากฏรายละเอียดเพิ่มเติมภายใต้หัวข้อ”การโฆษณาและการตลาด”ด้านล่างนี้)

· เพื่อใช้ในการทำความเข้าใจให้ดีว่าท่านเข้าถึงและใช้บริการของเราอย่างไร และเพื่อวัตถุประสงค์ในการปรับปรุงบริการของเรา รวมถึงการดำเนินการตามความประสงค์และความชื่นชอบของลูกค้าอีกทั้งเพื่อการปรับแต่งภาษาและตำแหน่งพื้นที่ การให้ความช่วยเหลือและการชี้แจ้งที่ทำให้เป็นลักษณะส่วนบุคคล หรือการดำเนินการอื่นๆที่เกี่ยวข้องกับการใช้บริการของท่านและลูกค้ารายอื่นๆ

· เพื่อช่วยเราพัฒนาบริการใหม่ๆและปรับปรุงบริการที่มีอยู่แล้ว

· เพื่อทำให้การปรับปรุงโฆษณาและการทำกิจกรรมทางการตลาด กิจกรรมทางการส่งเสริมการขายที่มีอยู่ใน หรือเกี่ยวข้องกับบริการของเราเป็นไปโดยมีประสิทธิภาพมากยิ่งขึ้น

· เพื่อวัตถุประสงค์ในการตรวจสอบซอฟต์แวร์หรือบริหารการปรับปรุงซอฟต์แวร์ และ

· เพื่อให้ท่านสามารถเข้าร่วมในการสำรวจและกิจกรรมอื่นๆเกี่ยวกับผลิตภัณฑ์และบริการของเรา

โปรดสังเกตว่าในกระบวนการที่เราจะให้บริการแก่ผู้ใช้เพื่อให้ได้รับประสบการณ์ที่ดีกว่า หรือเพื่อปรับปรุงบริการของเรา ข้อมูลส่วนบุคคล(ในกรณีที่ท่านให้ความยินยอมไว้)ที่ได้เก็บรวบรวมผ่านบริการใดๆของเราอาจจะอยู่ภายใต้การดำเนินการควบคุมความเป็นส่วนตัวโดยผู้ใช้เอง (ในกรณีที่ทำได้) ซึ่งใช้กับบริการอื่นๆของเรา (รวมถึงการดำเนินการในลักษณะของการสรุปข้อมูลหรือทำให้ข้อมูลหรือการทำข้อมูลเป็นรายบุคคลด้วย)

ยกตัวอย่างเช่น ข้อมูลส่วนบุคคลที่เก็บรวบรวมระหว่างการใช้บริการใดๆ ของท่านอาจมีการนำไปดำเนินการเพื่อคำแนะนำในเนื้อหาใดๆ เป็นการเฉพาะเพื่อแนะนำบริการอื่นๆให้แก่ท่านหรืออาจนำไปใช้เพื่อการโฆษณาที่เกี่ยวข้องแก่ท่านในบริการอื่น ทั้งนี้ท่านอาจจะร้องขอให้เราย้ายหรือจัดส่งข้อมูลส่วนบุคคลของท่านจากบริการใดบริการหนึ่งของเราไปยังบริการอื่นๆของเราในกรณีที่มีช่องทางให้สามารถทำการย้ายข้อมูลดังกล่าวได้

3. สิทธิของท่าน

ท่านอาจมีสิทธิภายใต้กฎหมายไทย หรือกฎหมายอื่นในการเข้าถึงข้อมูลส่วนบุคคลของท่าน และร้องขอที่จะแก้ไข ลบ หรือจำกัดการใช้ข้อมูลของท่าน ท่านมีสิทธิที่จะคัดค้านการใช้ ร้องขอให้ถ่ายโอนไป หรือเพิกถอนความยินยอมในการใช้ข้อมูลส่วนบุคคลของท่าน กรุณาศึกษาข้อมูลเพื่มเติมสำหรับการใช้สิทธิของท่านด้านล่างนี้

เราจะเคารพสิทธิของท่านภายใต้กฎหมายคุ้มครองข้อมูลส่วนบุคคล คุณมีสิทธิตามที่ระบุไว้ด้านล่างนี้ภายใต้กฎหมายไทย และอาจมีสิทธิที่เหมือนกันนี้ภายใต้กฎหมายอื่นๆ

· สิทธิในการเข้าถึงข้อมูล กล่าวคือท่านมีสิทธิที่จะเขียนคำร้องเพื่อขอทราบถึงข้อมูลส่วนบุคคลที่ถูกจัดเก็บ และขอรับสำเนาข้อมูลส่วนบุคคลที่ถูกจัดเก็บไว้

· สิทธิในการขอแก้ไข กล่าวคือท่านมีสิทธิที่จะร้องขอให้ลบข้อมูลส่วนบุคคลที่ไม่ถูกต้องและดำเนินการแก้ไขให้ถูกต้อง

· สิทธิในการลบข้อมูล (สิทธิที่จะถูกลืม) คือ สิทธิในการที่จะลบข้อมูลส่วนบุคคลของท่านออกจากบริการ

· สิทธิในการอนุญาตให้ใช้อย่างจำกัด กล่าวคือ สิทธิที่จะร้องขอให้ใช้ข้อมูลส่วนบุคคลของท่านอย่างจำกัดตามวัตถุประสงค์ที่ระบุไว้เฉพาะ

· สิทธิในการยกเลิกประชาสัมพันธ์ด้านการตลาด กล่าวคือท่านสามารถบริหารจัดการด้านการประชาสมพันธ์การตลาดได้ด้วยตนเองที่การยกเลิกการสื่อสารของเราที่ส่งถึงท่าน หรือเข้าไปยกเลิก ณ ศูนย์กลางที่ดูแลจัดการด้านการตลาดที่บังคับใช้อยู่ในบริการของเรา

· สิทธิในการคัดค้าน กล่าวคือ ท่านมีสิทธิที่จะคัดค้านการใช้ข้อมูลส่วนบุคคลของท่าน ในกรณีที่ข้อมูลส่วนบุคคลของท่านถูกนำไปใช้เพื่อประโยชน์สาธารณะ หรือในกรณีที่เราให้ท่านทราบถึงการใช้ข้อมูลส่วนบุคคลของท่านในรูปแบบสิทธิตามกฎหมายของเราหรือของบุคคลภายนอก

· สิทธิในการร้องขอให้ถ่ายโอน คือ สิทธิทีจะร้องขอให้ถ่ายโอนข้อมูลส่วนบุคคลของท่านที่เราจัดเก็บไปยังผู้ให้บริการอื่น หรือบริการอื่น

· สิทธิในการเพิกถอนความยินยอม คือ สิทธิที่ท่านจะเพิกถอนความยินยอม ณ เวลาใดๆ ที่ท่านเคยไว้ก่อนหน้านี้แก่เราในการใช้ จัดการข้อมูลส่วนบุคคลของท่าน ถ้าคุณเพิกถอนความยินยอมที่ให้ไว้แก่เรา จะไม่ส่งผลถึงการใดๆก่อนหน้าที่เราได้ใช้ และประมวลผลข้อมูลส่วนบุคคลของท่านโดยอ้างสิทธิตามกฎหมาย

สิทธิดังกล่าวข้างต้นไม่ใช่สิทธิเด็ดขาดและไม่สามารถปรับใช้ได้ทุกกรณี

ในการตอบสนองคำร้องขอ เราอาจจะร้องขอให้ท่านยืนยันตัวตนหากจำเป็น และจัดหาข้อมูลเท่าที่จำเป็นเพื่อให้เราเข้าใจคำร้องขอของท่านมากยิ่งขึ้น หากเราไม่สามารถปฏิบัติตามคำร้องขอของท่านได้ไม่ว่าทั้งหมดหรือบางส่วน เราจะแจ้งให้ท่านทราบถึงเหตุผลดังกล่าว

ในการใช้สิทธิของท่าน โปรดติดต่อผู้ดูแลข้อมูลส่วนบุคคลตามช่องทางการติดต่อที่แจ้งไว้ทางด้านบน

4. คุกกี้ เว็บบีคอนและเทคโนโลยีที่คล้ายคลึงกัน

กรุณาตรวจสอบข้อมูลเพิ่มเติมในนโยบายเกี่ยวกับคุกกี้ของเรา ในเรื่องที่เกี่ยวกับว่าเราใช้คุกกี้ เว็ปบีคอนและเทคโนโลยีที่คล้ายคลึงกันอย่างไร

5. การโฆษณาและการตลาด

เราอาจใช้ข้อมูลของท่านเพื่อจัดส่งโฆษณาที่เกี่ยวข้องกับคุณผ่านช่องทางต่างๆ เช่น อีเมล์ โทรศัพท์ ข้อความ หรือสื่อออนไลน์ อย่างไรก็ตามเราจะให้ท่านเป็นผู้เลือกตามที่กฎหมายกำหนดอย่างชัดเจนว่าท่านตกลงที่จะรับข้อความสื่อสารด้านการตลาดกับเราหรือไม่ ในกรณีที่เราประชาสัมพันธ์ด้านการตลาดไปยังท่าน ข้อความดังกล่าวจะระบุวิธ๊ยกเลิกการรับข้อความในอนาคตให้ท่านทราบด้วย

เราเคารพสิทธิในการเลือกที่จะรับการประชาสัมพันธ์ด้านการตลาดของท่าน ท่านมีสิทธิที่จะยกเลิกการรับการประชาสัมพันธ์ด้านการตลาดโดยตรงและตัวเลือกโฆษณาออนไลน์

วิธียกเลิกการรับการประชาสมพันธ์การตลาดผ่านอีเมล์

ในกรณีที่เราส่งอีเมล์ประชาสัมพันธ์การตลาดถึงท่าน เราจะจัดหาช่องทางให้ท่านยกเลิกการรับข้อความดังกล่าวบนอีเมล์นั้นๆ เพื่อที่จะปรับปรุงตัวเลือกากรโฆษณาบนอีเมล์ของท่าน กรุณาไปที่การตั้งค่าอีเมล์ที่ท่านใช้อยู่ นอกจากนี้ท่านยังสามารถติดต่อมาอย่างเราผ่านช่องทางติดต่อเราบนแต่ละบริการเพื่อพูดคุยกับเรา

อย่างไรก็ตาม แม้ว่าท่านจะยกเลิกการรับการประชาสัมพันธ์ด้านการตลาดผ่านอีเมล์ เราอาจจะยังติดต่อไปถึงท่านเกี่ยวกับบริการของเราหรือข้อมูลสำคัญที่เกี่ยวกับบัญชีผู้ใช้ของท่านและการสมัครสมาชิก (เพื่อวัตถุประสงค์ในการดูแลลูกค้า)

นอกจากนี้ท่านอาจเลือกที่จะปิดการติดตามตำแหน่งพื้นที่บนโทรศัพท์เคลื่อนที่ของท่าน ถ้าท่านปิดเครื่องมือดังกล่าว เราจะไม่สามาถใช้ข้อมูลที่จัดเก็บผ่านสช่องทางการโฆษณาที่ระบุไปยังอุปกรณ์ของท่านสำหรับวัตถุประสงค์ในการโฆษณาได้ ท่านอาจจะยังคงเห็นโฆษณาจำนวนเท่าเดิมแต่จะไม่เกี่ยวข้องกับความสนใจของท่าน ในกรณีที่เราจำเป็นที่จะต้องเก็บข้อมูลที่อยู่ของท่าน เราจะขอความยินยอมจากท่านก่อนทุกครั้ง

6. ทางเลือกการโฆษณาสำหรับท่าน

การโฆษณาทำให้เราสามารถนำมาซึ่งเนื้อหาที่ดีสำหรับแต่ละบริการบนเครือข่ายของเรา โดยเป็นที่รู้กันว่าเนื้อหาเหล่านี้ไม่มีค่าใช้จ่ายใดๆ สำหรับผู้ใช้บริการ ดังนั้น เราใช้ความพยายามอย่างมากในการนำเสนอโฆษณาที่อยู่ในความสนใจของท่านและผลิตภัณฑ์ที่ท่านต้องการ

เครื่องมือที่อยู่บนหน้าของทางเลือกการโฆษณา ตลอดจนบนหน้าของกลุ่มพันธมิตรโฆษณาดิจิทัล และหน้าระบบริเริ่มเครือข่ายโฆษณาที่สร้างขึ้นโดยบุคคลภายนอกหรือบริษัทคู่ค้า เรเดียม จำกัด และ หรือ บริษัท บีลีฟวิ่ง อินเตอร์เนชั่นเนล จำกัด ไม่ได้เป็นผู้ควบคุมหรือใช้งานเครื่องมือเหล่านี้หรือกำหนดทางเลือกต่าง ๆ ที่ผู้โฆษณาทั้งหลายใช้ผ่านเครื่องมือเหล่านี้แต่ประการใด

เมื่อใช้แอพพลิเคชั่นบนโทรศัพท์มือถือ ท่านอาจได้รับโฆษณาที่พ่วงมาด้วยบนแอพพลิเคชั่น ซึ่งขึ้นอยู่กับอุปกรณ์ บนโทรศัพท์มือถือของท่าน ท่านอาจจะสามารถตั้งค่าการบันทึกข้อมูลโฆษณาบนโทรศัพท์มือถือใหม่ตลอดเวลา โดยเข้าถึงการตั้งค่าความเป็นส่วนตัวบน โทรศัพท์มือถือของท่าน นอกจากนี้ บนระบบปฏิบัติการแต่ละประเภท iOS สำหรับโทรศัพท์มือถือแอปเปิล แอนดรอยด์สำหรับอุปกรณ์แอนดรอยด์ และวินโดวร์สำหรับอุปกรณ์ไมโครซอฟต์ จะมีวิธีการของตัวเองสำหรับป้องกันการส่งโฆษณาที่พ่วงมาด้วยบนแอพพลิเคชั่น ท่านอาจต้องศึกษาคู่มือ หรือการตั้งค่า ความเป็นส่วนตัวสำหรับแต่ละระบบปฏิบัติการเพื่อที่จะนำโฆษณาที่พ่วงมาด้วยกับ แอพพลิ เคชั่นออกไป และสำหรับอุปกรณ์อื่น ๆ และ/หรืออุปกรณ์บนระบบปฏิบัติการอื่นใดนอกเหนือจากที่กล่าวมา โปรดเข้าไปที่หัวข้อการตั้งค่าความเป็นส่วนตัวสำหรับอุปกรณ์ที่ใช้งาน หรือติดต่อ หรือศึกษานโยบายความเป็นส่วนตัว บนหน้าเว็บไซด์ ของระบบปฏิบัติการนั้น ๆ

7. การแบ่งปันข้อมูลส่วนบุคคลของท่านร่วมกับผู้อื่น

ในกรณีที่เราอนุญาตให้บุคคลอื่นเก็บรวบรวมและใช้ข้อมูลส่วนบุคคลของท่านตามเงื่อนไขที่ระบุไว้ในวรรคก่อนเราจะดำเนินการตามสมควรเพื่อให้แน่ใจว่าบุคคลอื่นเหล่านั้นจะใช้ข้อมูลส่วนบุคคลของท่านเพื่อวัตถุประสงค์ในเรื่องดังต่อไปนี้เท่านั้น (1)เป็นไปโดยสอดคล้องกับนโยบายในความเป็นส่วนตัวฉบับนี้และ (2)อยู่ภายใต้บังคับของคำสั่งอื่นๆที่เราได้กำหนดและแจ้งให้แก่บุคคลข้างต้นได้รับทราบรวมถึงนำมาตรการที่เหมาะสมที่เราใช้ใน การรักษาความลับและความปลอดภัยของข้อมูลไปปฏิบัติด้วย

ท่านให้ความยินยอมแก่บุคคลอื่นตามที่ระบุไว้เพื่อใช้ข้อมูลส่วนบุคคลของท่านรวมถึงการนำข้อมูลส่วนบุคคลของท่านไปแบ่งปันหรือโอนให้กับผู้อื่น(รวมทั้งกรณีที่อยู่ในและอยู่นอกเขตอำนาจศาลที่ใช้บังคับกับท่าน)ตามที่ได้ระบุไว้ในหัวข้อ “การแบ่งปันข้อมูลส่วนบุคคลของท่านร่วมกับผู้อื่น”

ท่านตกลงว่าเราและบริษัทในเครือของเราอาจจำเป็นที่จะต้องคงไว้ เก็บรักษาหรือเปิดเผยข้อมูลส่วนบุคคลของท่าน(1) เพื่อปฏิบัติตามหลักเกณฑ์และกฎหมายที่เกี่ยวข้อง (2)เพื่อปฏิบัติตามคำสั่งศาล หมายศาลหรือกระบวนการในทางกฎหมายอื่นๆ (3) เพื่อดำเนินการตามคำร้องขอของหน่วยงานของรัฐ หน่วยงานทีมีอำนาจบังคับใช้กฎหมายหรือหน่วยงานอื่นใดในทำนองเดียวกัน (ไม่ว่าจะตั้งอยู่ในเขตอำนาจศาลที่ใช้บังคับกับท่านหรือที่อื่นก็ตาม) หรือ(4) ในกรณีที่เราเชื่อว่ามีความจำเป็นอันสมควรที่จะต้องปฏิบัติตามหลักเกณฑ์หรือกฎหมายที่เกี่ยวข้อง ทั้งนี้ท่านตกลงว่าเราหรือบริษัทในเครือของเราอาจจำเป็นที่จะต้องเปิดเผยข้อมูลส่วนบุคคลของท่านเพื่อบังคับใช้เงื่อนไขเกี่ยวกับการให้บริการหรือนโยบายในความเป็นส่วนตัวฉบับนี้เพื่อความมุ่งหมายในการปกป้องสิทธิของเรา ทรัพย์สินหรือความปลอดภัยหรือสิทธิ ทรัพย์สินหรือความปลอดภัยของบริษัทในเครือของเราหรือผู้ใช้บริการของเรารายอื่นๆ

8. การติดต่อสื่อสารจากเรา

จดหมายข่าวและการติดต่อสื่อสารในรูปแบบอื่น

บริการโซเชียลมีเดียหรือบริการอื่นๆของผู้ให้บริการภายนอกเหล่านี้อาจเป็นการให้บริการโดยบุคคลภายนอกที่เกี่ยวข้องหรือโดยเราก็ได้ การใช้บริการภายนอกข้างต้น(ไม่ว่าจะเป็นบริการโซเชียลมีเดียหรือบริการอื่นใดก็ตาม)รวมถึงข้อมูลส่วนบุคคลที่ท่านมีการส่งให้กับบุคคลภายนอกดังกล่าวจะอยู่ภายใต้บังคับของเงื่อนไขการให้บริการและนโยบายในความเป็นส่วนตัวที่เกี่ยวข้องของบุคคลภายนอกนั้นๆและ ข้อกำหนดการใช้บริการ ของเราหรือนโยบายในความเป็นส่วนตัวฉบับนี้จะไม่นำไปใช้บังคับ ดังนั้นกรุณาพิจารณาเงื่อนไขต่างๆของผู้ให้บริการภายนอกดังกล่าวอย่างรอบคอบ

11. ข้อจำกัดในเรื่องอายุ

เราไม่ได้มุ่งการให้บริการไปยังผู้เยาว์ที่อายุต่ำกว่า 10 ปี เนื่องจากบริการของเรามีความจำเป็นต้องใช้วิจารณญาณในการรับชม จึงมุ่งเน้นให้บริการแก่บุคคลที่บรรลุนิติภาวะแล้วตามกฎหมาย อย่างไรก็ตาม เนื่องจากบริการของเราบุคคลสามารถเข้าถึงได้โดยทั่วไป ดังนั้น หากปรากฏว่าเราได้เก็บรวบรวมข้อมูลผู้เยาว์ที่มีอายุต่ำกว่า 10 ปี และ/หรือบุคคลที่ยังไม่บรรุลนิติภาวะ กรุณาติดต่อเจ้าหน้าที่ดูแลความเป็นส่วนตัวของเรา และเราจะตรวจสอบข้อมูลส่วนบุคคลดังกล่าวในทันที (รวมถึงลบข้อมูลดังกล่าวในกรณีที่เราตรวจพบ)

12. การถ่ายโอนระหว่างประเทศ

บริการนี้ถูกควบคุมกำกับดูแลและดำเนินการภายใต้กฎหมายของราชอาณาจักรไทย หากท่านอยู่นอกพื้นที่ราชอาณาจักรไทย ถือว่าท่านได้ใช้บริการนี้ด้วยความเสี่ยงของตัวท่านเอง โดยที่บริษัท เรเดียม จำกัด อาจมีความจำเป็นที่จะต้องถ่ายโอนข้อมูลของท่านระหว่างประเทศ โดยเฉพาะอย่างยิ่ง ข้อมูลของท่านจะถูกถ่ายโอนไปยังและจัดการอยู่ในราชอาณาจักรไทยที่เป็นศูนย์รวมข้อมูลของเรา และท่านรับทราบว่าการปกป้องข้อมูลและกฎหมายอื่นของต่างประเทศที่ไม่ใช่ประเทศของท่าน เช่น ราชอาณาจักรไทย อาจมีความคุ้มครองหรือมาตรฐานการคุ้มครองน้อยกว่าที่มีอยู่ในประเทศของท่าน และท่านยินยอมให้เก็บข้อมูล ดำเนินการและถ่ายโอนข้อมูลของท่านตามที่กำหนดไว้ในนโยบายความเป็นส่วนตัวและกฎหมายราชอาณาจักรไทยสำหรับการใช้บริการนี้ นอกจากนี้เราจะทำตามขั้นตอนตามกฎหมายอย่างเหมาะสมเพื่อที่จะมั่นใจว่าข้อมูลส่วนบุคคลถูกจัดการ รักษา และถ่ายโอนอย่างปลอดภัย ในบางกรณีเราอาจจำเป็นที่จะต้องเปิดเผยหรือโอนถ่ายข้อมูลส่วนบุคคลไปยังสำนักงานใหญ่ หรือบุคคลภายนอก ในพื้นที่นอกเหนือจากประเทศของท่าน

This Statement may be subject to updates. Any material future changes or additions to the processing of personal information as described in this Statement affecting you will be communicated to you through an appropriate channel. For example, we may place a prominent notice on a product site or email you to let you know of an updated Statement.

1. THE INFORMATION WE COLLECT AND HOW WE COLLECT IT

In providing our services, we collect, store and use the following Information relating to you:

“Information” is Personal Information and Non-Personal Information;

"Personal Information" is any information or combination of information that relates to you, and can be used to identify you. Personal Information may include the following:

· information you make available to us when you open an account or use our services, such as your name, telephone number, email address and credit card details;

· information which you make available to our services as you use them, including Shared Information you make available to others through our services and information you store using our services;

· shared Information that others using our services make available about you, such as information contained in posts they make and communications they make to you or others using our services;

· online identifier which may be collected with unique identifiers tied to the browser, application, or device you are using. This helps us do things like maintain your language preferences across browsing session; and

· information we collect as you use our services, such as certain Location Data, Log Data and public information.

““Location Data” is information that we collect regarding your location (when you use a location-enabled service), including:

· the location of your device when you use our services, such as from the GPS, WiFi, compass, accelerometer or other sensors in your device;

· the IP address of the device or internet service you use to access our services,

· other information made available by you or others that gives an indication as to where you are or have been located, such as account information that indicates where you are located and Shared Information you or others post indicating your location, such as any geotag information that is embedded in any photos you make available to us; and

· if you have provided us with your location data previously and would like us to delete such existing location data, you may be able to do so via our services.

"Log Data" is technical information that is automatically collected by us when you use our services, whether through the use of cookies (as explained in more detail in the Cookies Policy ) or otherwise, including:

· technical information such as your mobile carrier, configuration information made available by your web browser or other programs you use to access our services, your IP address as well as your device’s version and serial number.

· information about what you have searched for and looked at while using our services, such as web search terms used, social media profiles visited and details of other information and content accessed or requested by you in using our services;

· information about application and other software you have used and how you have used them;

· information about communications you have made using our services, such as the people you’ve communicated with and the time, data and duration of your communications; and

· metadata, which means information related to items you have made available through our services, such as the date, time or location that a shared photograph or video was taken or posted.

“Non-Personal Information” is any information that relates to you but from which it is not practicable to directly or indirectly identify you, including Personal Information in aggregated, anonymised or pseudonymised form.

“Shared Information” is information about you or relating to you that is voluntarily shared on our services, including postings that you make on our services (including your public profile, the lists you create), any postings from others that you re-post and including Location Data and Log Data associated with these postings. Shared Information also includes information about you (including Location Data and Log Data) that others who are using our services share about you.

We may use your Information for any of the following purposes:

· to better understand how you access and use our services, for the purposes of trying to improve our services and to respond to customer desires and preferences, including language and location customisation, personalised help and instructions, or other responses to your and other customers’ usage of our services;

· to help us develop our new services and improve our existing services;

· to assess the effectiveness of and improve advertising and other marketing and promotional activities on or in connection with our services;

· for the purposes of software verification or administering software upgrades; and

· to allow you to participate in surveys and other activities about our products and services.

Please note that for the purposes of seeking to provide our users with a better experience, to improve our services or otherwise where you have consented, Personal Information collected through one of our services may, subject to user privacy controls (where available), be used by our other services (including in an aggregated or individualized manner).

For example, Personal Information collected during your use of one of our services may be used to suggest particular content that can be made available to you on another service or be used to try to present more relevant advertising to you in another service. You may also from time to time ask us to migrate or export your Personal Information contained in one of our services to another of our services, where such migration option is available.

You may have rights under Thai and other laws to have access to your personal information and to ask us to rectify, erase and restrict use of, your personal information. You may also have rights to object to your personal information being used, to ask for the transfer of personal information you have made available to us and to withdraw consent to the use of your personal information. Further information on how to exercise your rights is set out below.

We will honor your rights under applicable data protection laws. You have the following rights under Thai laws, and may have similar rights under the laws of other countries.

· Right of subject access: The right to make a written request for details of your personal information and a copy of that personal information

· Right to rectification: The right to have inaccurate information about you corrected or removed

· Right to erasure ('right to be forgotten'): The right to have certain personal information about you erased

· Right to restriction of processing: The right to request that your personal information is only used for restricted purposes

· Right to opt out of marketing: You can manage your marketing preferences by unsubscribe links found in the communications you received from us or by visiting the preference setting

· Right to object: The right to object to processing of your personal information in cases where our processing is based on the performance of a task carried out in the public interest or we have let you know the processing is necessary for our or a third party’s legitimate interests. In these circumstances the right to object is not absolute.

· Right to data portability: The right to ask for the personal information you have made available to us to be transferred to you or a third party in machine-readable format

· Right to withdraw consent: The right to withdraw any consent you have previously given us to handle your personal information. If you withdraw your consent, this will not affect the lawfulness of our use of your personal information prior to the withdrawal of your consent

These rights are not absolute and they do not always apply in all cases. In response to a request, we will ask you to verify your identity if we need to, and to provide information that helps us to understand your request better. 5. ADVERTISING AND MARKETING

We deliver marketing and event communications to you across various platforms such as email, telephone, text messaging, direct mail and online. Where required by law, we will ask you to explicitly opt in to receive marketing from us. If we send you a marketing communication it will include instructions on how to opt out of receiving these communications in the future.

Honoring your marketing preferences is important to us. You have the right to opt out of receiving direct marketing and targeted online advertising.

How to Opt Out of Email Marketing

Where we send marketing emails, we provide unsubscribe options for your use within our emails. To update your email marketing preferences, please visit the applicable preference setting, a link to which will normally be included in emails you receive from us. In addition, you can also use the “Contact Us” feature of a particular Service to discuss with us

Even if you opt out of receiving marketing communications by email, we may still send you service communications or important transactional information related to your accounts and subscriptions (for purposes such as providing customer support).

You may also choose to turn off location tracking on your mobile device. If you turn off ad tracking or location tracking, we will no longer use information collected from your device’s advertising identifier for the purposes of advertising. You may still see the same number of ads but they may be less relevant because they will not be based on your interests. Where we need your consent to gather information about your location we will obtain this from you.

6. YOUR AD CHOICES

Advertising enables us to provide the rich content for which Services on the Radium Co.,Ltd and or B’ Living International Co., Ltd are known, and to provide much of this content free of cost to our Users. Thus, we strive to provide you with ads that are relevant to you and for products you may want.

When using a mobile application you may receive tailored in-application advertisements. Depending on your device, you may be able to reset your mobile device's advertising identifier at any time by accessing the privacy settings on your mobile device. In addition, each operating system, iOS for Apple phones, Android for Android devices and Windows for Microsoft devices, provides its own instructions on how to prevent the delivery of tailored in-application advertisements. You may review the support materials and/or the privacy settings for the respective operating systems in order to opt-out of tailored in-application advertisements. For any other devices and/or operating systems, please visit the privacy settings for the applicable device or contact (or review the applicable privacy web page of) the applicable platform operator.

7. SHARING OF YOUR PERSONAL INFORMATION

Other than as permitted under this Privacy Policy or as otherwise consented to by you, we will not transfer your Personal Information to any other third parties for their processing for any purposes. We and our affiliate companies may share your Personal Information within our group of companies and with joint venture partners and third party service providers, contractors and agents (such as communication service providers who send emails or push notifications on our behalf, mapping services providers who assists us and you with location data, analytics partners who assist our business, and advertising partners on our services). In addition, we may allow such third parties to collect your Personal Information across our services. In each case, we permit such sharing and/or collection for the purposes of: (i) providing our services to you; (ii) assisting us in carrying out the purposes set out under the “How We Use Your Information” section above; (iii) carrying out our obligations and enforcing our rights under the Terms of Service or this Privacy Policy; and/or (iv) our business, including helping us better understand and improve our services. Where we permit any third parties to collect and use your Personal Information in accordance with the above paragraph, we will use reasonable efforts to ensure that such third parties only use your Personal Information: (i) in compliance with this Privacy Policy; and (ii) subject to any other instructions we give them, including any appropriate confidentiality and security measures that we implement. You consent to the third party use, sharing and transfer of your Personal Information (both inside and outside of your jurisdiction) as described in this "Sharing of your Personal Information" section

As we continue to develop our business, we or our affiliate companies may be acquired by a third party or re-organize our group structure. In these circumstances, it may be the case that your Information is transferred within our group and/or transferred to a third party who will continue to operate our services or similar services under either this Privacy Policy or a different privacy policy which will be notified to you. The party to which your Personal Information is transferred may be located, and use your Information, outside of your jurisdiction.

A WORD ABOUT SHARED INFORMATION

A number of our services enable Shared Information to be shared publicly with all users of that service and not just your contacts. Our social media services in particular are primarily designed to help you share Shared Information with the world, so Shared Information can be broadly and instantly transmitted and will remain public for as long as you do not delete it (and even after you delete Shared Information, it may still be separately cached, copied, or stored by, or remain public through, other users or third parties who are not affiliated with and not controlled by us).

8. COMMUNICATIONS FROM US

Newsletters and other types of communications

When you use our services, we may use your Information to send you emails, newsletters or push notifications to your device. If you no longer wish to receive these communications, you can do so by following the unsubscribe instructions in the emails we send to you, opting out of notifications at the device level (if available) or contacting our Privacy Officer.

Service-related announcements

We may from time to time send you service-related announcements when we consider it necessary to do so (such as when we temporarily suspend one of our services for maintenance). You may not opt-out of these service-related announcements, which are not promotional in nature.

9. A WORD ABOUT SENSITIVE PERSONAL INFORMATION

In some jurisdictions, certain Personal Information, such as information about your race or ethnic origin, religious or philosophical views or personal health, is characterized as “sensitive” and is subject to stricter regulation than other personal information. Please note that content and information that you input to our services, such as photographs or information about your school or social activities, may reveal your sensitive Personal Information to others.

Please note that we do not use your sensitive Personal Information for the purpose of serving advertising to you.

We urge you to consider whether it is appropriate to communicate sensitive Personal within our services.

10. THIRD PARTY SERVICES ON OUR SERVICES

Our services may include, or they may link you to, social media or other services (including websites) provided by a third party. For example:

· you may be able to share content on our services using services provided by third parties. The third parties who provide such services may be able to collect your Information and Personal Information (including your Log Data), and may set cookies on your computer to enable such third party services to function properly; and

· We may (whether in advertisements or otherwise within our services) provide you with links that allow you to access third party services or websites.

These third party social media or other services may be hosted by the relevant third party or us. Your use of any such third party services (whether social media services or otherwise), including any Personal Information you provide to such third parties, are subject to the relevant third party’s own Terms of Services and privacy policies and not the Terms of Service or this Privacy Policy, so please review their terms carefully.

This Privacy Policy only applies to any Information collected by us, does not apply to any services offered by or information practices of any third parties, and we bear no liability for any third party use of any Information provided by you to them.

11. AGE RESTRICTIONS

We do not generally aim our service at any children per local legislation because our service needs attentiveness. We do aim our service at people who reach their legal age. In the limited circumstances where we may collect and use personal information about children or any person who are still not the majority, please contact our Privacy Officer and we will promptly investigate (and remove, if we have any) such Personal Information.

12. INTERNATIONAL TRANSFER

This Service is governed by and operated in accordance with Thai law. If you are located outside of Thailand, you use this Service at your own risk. Radium Co., Ltd. may be required to transfer your Information internationally. In particular, your Information will be transferred to and processed in the Thailand where many of our central databases operate. By using this Service, you acknowledge that the data protection and other laws of other countries, such as Thailand, may provide a less comprehensive or protective standard of protection than those in your country, and consent to your Information being collected, processed and transferred as set forth in this Privacy Policy and Thai law. We take appropriate steps to ensure that personal information is processed, secured and transferred according to applicable law. In some cases, we may need to disclose or transfer your personal information to headquarter or to third parties in areas outside of your home country.

13. HOW WE SECURE PERSONAL INFORMATION

We have put in place physical, electronic, and managerial procedures designed to help prevent unauthorized access, to maintain data security, and to use correctly the Information we collect online. These safeguards vary based on the sensitivity of the Information that we collect and store.

In some cases, we will use encryption technology (such as SSL) to protect certain sensitive Information provided by you to us. Please be aware that despite our efforts, no data security measures can guarantee 100% security at all times. Our systems and the communications networks through which you access our services may be subject to security breaches and failures; which are due to circumstances beyond our reasonable control.

14. RETENTION PERIOD OF PERSONAL INFORMATION

Subject to applicable laws and regulations (including as set out under the “Sharing of your Personal Information” section above), we will only retain your Personal Information for so long as is necessary to fulfill the purposes as set out under the “How We Use Your Information” section above.

We retain your information in accordance with our enterprise records retention schedule. You can find more information on the criteria used to calculate the retention periods set out below.

Radium Co., Ltd has a Records and Information Governance team that works in conjunction with our Privacy Team to implement policies and rules relating to the retention of personal information. We have an enterprise records retention schedule that is based upon a classification scheme consisting of business functions, record classes, and record types.

We calculate retention periods for your personal information in accordance with the following criteria:

1. the length of time necessary to fulfil the purposes we collected it for

2. when you or your employer (or other subscriber providing for your access to our Services) cease to use our Services

3. the length of time it is reasonable to keep records to demonstrate that we have fulfilled our duties and obligations

4. any limitation periods within which claims might be made

5. any retention periods prescribed by law or recommended by regulators, professional bodies or associations

6. the existence of any relevant proceedings
